The full panel of the Hamburg Local Division confirmed a settlement reached between the claimant and the first and second defendants in an infringement action, on the joint application of those parties. Art. 79 UPCA together with R. 365.1 RoP allows the Court to confirm a settlement at the parties' request, and R. 365.2 RoP allows the details to be treated as confidential on request. On costs, the panel applied R. 365.4 RoP, under which the judge-rapporteur decides on costs in accordance with the terms of the settlement or, failing such terms, at his discretion; it read the parties' request as asking that the costs arrangement agreed in the settlement be reflected in the decision, and ordered accordingly. The confirmation is entered in the register under R. 365.3 RoP, while confidentiality of information in written pleadings is secured by the registry under R. 262.2 RoP, a further court order being needed only under R. 262.6 RoP once a request under R. 262.3 RoP has been made.
