The Hamburg Local Division, sitting as a full panel, confirmed a settlement concluded between the claimant, the second counterdefendant and the third defendant under Art. 79 UPCA in conjunction with R. 365.1 RoP, and ordered the details of the settlement to be treated as confidential under R. 365.2 RoP. On costs the Division applied R. 365.4 RoP, under which the judge-rapporteur decides the costs in accordance with the terms of the settlement or, failing such terms, at his or her discretion, and construed the parties' request that no cost decision be made as a request that the cost arrangement agreed in the settlement be reflected in the R. 365.4 RoP decision.
