The Mannheim Local Division rejected the Defendants' preliminary objection that was mainly based on an alleged violation of the principle of fair trial because the Claimant had sued three different competitors in one complaint while suing the OEM / supplier in different proceedings. The Court found itself competent and rejected the Defendants' argument, stating that the competitors could have been sued individually or as a group.
This order was followed by another order issued on 9 April 2025 where the Court rejected the application to separate the proceedings.
