notable
The Mannheim Local Division dismissed a sweeping R. 190 RoP request by OPPO for production of Panasonic's entire 3G/4G-SEP licensing portfolio, limiting SEP holders' pre-adjudication disclosure obligation to the specific comparable licenses they choose to rely on for their FRAND offer. Reading Huawei v. ZTE (C-170/13) together with the proportionality principle, the Court held that the SEP holder's CJEU-derived transparency duty does not, at this stage and before any decision on the implementer's willingness to license, entitle the implementer to broad production of unnamed comparable licenses, third-party licenses or portfolio sale overviews. The Court pointedly declined to follow the Munich Local Division's divergent approach in parallel Panasonic–OPPO proceedings. Broad or unspecified R. 190 applications are to be treated as inadmissible fishing expeditions; procedural consequences are reserved for a later stage if it emerges that a SEP holder has deliberately withheld suitable comparables.
