v.
President And Fellows Of Harvard College - UPC_CFI_252/2023
routine
The judge-rapporteur (Kupecz) issued an Order following the interim conference in a pending revocation action concerning EP 2 794 928, setting the procedural frame for the oral hearing of 17 April 2024. On case-management issues, the Court (i) granted the Claimant's request not to translate document D40 (a Munich Regional Court decision) in the absence of objection; (ii) admitted Claimant's late-filed prior-art document D46 after the Defendant withdrew its objection, giving Defendant six weeks and a 10-page cap to respond; and (iii) emphasised, under Rule 50.2 in conjunction with Rule 30.2 RoP, the front-loaded character of UPC proceedings — declining to bar further auxiliary requests pre-emptively or to order convergence of the Defendant's AR set. The value of the proceedings for recoverable-cost purposes was set at EUR 7.5 million, yielding a ceiling of EUR 600,000 under the AC scale (Art. 69 UPCA, Rule 152.3 RoP); parties were given until 3 April 2024 (updateable by 16 April) to lodge detailed cost submissions including hours, roles, and rates. The Court also fixed 15 March 2024 as the presumptive cut-off after which amendments to the case will be treated as violating Rule 263.2(a) RoP.
