request for procedural order.

notable
The CD Paris (Panel 2), through Judge-rapporteur Catallozzi, set out the framework for deadline extensions under R. 9.3 RoP and refused Roche's request to extend the deadline to file its defence in a declaration-of-non-infringement action pending a decision on Roche's own preliminary objection. The order identifies four purposes of the RoP deadline regime (speed, fair trial, judicial impartiality, legal certainty) and holds that R. 9.3(a) RoP discretion may be exercised only in justified exceptional cases where a party shows objective impossibility or very great difficulty in meeting the deadline. The mere prospect that pleadings may become unnecessary if a preliminary objection succeeds is not such a case. The order also clarifies that under R. 19(6) RoP, applied mutatis mutandis to DNI actions via R. 66 RoP, lodging a preliminary objection does not affect the statement-of-defence deadline unless the judge-rapporteur decides otherwise; and that discretion is governed by the same demanding standard.
