notable
The Munich CD (JR Kupecz) combined for joint hearing two parallel revocation proceedings on the same patent (Amgen's EP 3 666 797) — Sanofi's direct revocation action (UPC_CFI_1/2023) and Regeneron's counterclaim for revocation referred from the Munich LD (UPC_CFI_14/2023). Under the combining mechanism agreed with the parties, all facts, arguments, pleadings, applications and evidence filed in either action are deemed submitted in the other, submissions going forward must be identical in both cases, and only costs may be dealt with separately. Regeneron was given a short reply window to the Amgen Defence to the counterclaim (by 7 March 2024, with a mirrored Amgen 'rejoinder' by 21 March 2024); case summaries (max 7,500 words), slide demonstratives (no models), and a consolidated exhibit list were authorised; competition-law arguments were confirmed to be outside the revocation grounds and removed from the proceedings. Value of each action was fixed at EUR 100 M with a EUR 2 M ceiling per action, and the Court expressly held that the ceiling applies to each action separately. Documents D99 and C10a, inadvertently omitted from Amgen's Rejoinder, were admitted. The pre-existing oral hearing date of 4 June 2024 was kept for both actions.
