A preliminary objection under Rule 19.1 (a) RoP may not be based on the claimant's (alleged) lack of capacity to sue and/or on his or her assertion of claims arising out of an assignment.
The Munich Local Division rejected a preliminary objection as inadmissible since it was based on the - alleged - lack of the claimant's standing to sue. The Court stated that the standing to sue was not a valid reason to be brought forward with a preliminary objection under Rule 19 RoP.
