v.
Roche - UPC_CFI_454/2023
request for procedural order
notable
Parallel order to UPC_CFI_455/2023. CD Paris (Panel 2), through Judge-rapporteur Catallozzi, refused Roche's request to extend the deadline for filing its defence to revocation pending a ruling on its preliminary objection to jurisdiction. Applying the same R. 9.3 RoP framework, the order identifies four purposes of the RoP deadline regime and holds that extensions are available only in justified exceptional cases where objective impossibility or very great difficulty is shown; the mere prospect that pleadings may become unnecessary if the preliminary objection is allowed is not sufficient. Under R. 19(6) RoP, applicable to revocation actions mutatis mutandis via R. 48 RoP, lodging a preliminary objection does not affect the defence deadline unless the judge-rapporteur decides otherwise.
