1. Since Rule 265 (1) of the Rules of procedure (‘RoP’) does not require the express consent of the opposing party, it is sufficient that the party was given an opportunity to comment on the withdrawal and did not object within the time limit set by the Court.
In this order granting leave to withdraw a revocation action, the Paris Central Division found that the respondent's consent regarding the withdrawal does not necessarily have to expressed within the time limit set by the court. In the case at hand, the respondent had filed their consent a few days after the court's deadline had already expired.
