The Court of Appeal, by its President as judge-rapporteur, decided a law firm's request under R. 262.1(b) RoP for access to the rehearing request and the response filed in rehearing proceedings that had closed on withdrawal. Applying the Ocado framework (UPC_CoA_404/2023), under which the interests are usually properly balanced if access is granted after the proceedings have ended by a decision, and Abbott v Powell Gilbert (UPC_CoA_480/2024), under which a law firm can be a member of the public, the Court held that the applicant's stated interest in understanding the conduct of the proceedings for advising clients satisfied the requirements of a reasoned request. Access was refused for the two exhibits, which contained the representative's bank details and information on the representative's invoices, and the pleadings released were to be redacted of personal data under Regulation (EU) 2016/679 by the Registry. The decision applies settled Court of Appeal practice.
