The judge-rapporteur of the Court of Appeal ordered the reimbursement of EUR 61,150 in court fees that the cross-appellants overpaid when lodging a cross-appeal against a Local Division decision on a counterclaim for revocation. Under Table IV of the Table of Court Fees, the fee for an appeal concerning a counterclaim for revocation is the first-instance fee for that counterclaim raised by 10%. With the first-instance counterclaim fee at EUR 26,500, the correct appeal fee was EUR 29,150, whereas EUR 90,300 had been paid as displayed in the Case Management System. The order applies R. 371.4 RoP, which provides for reimbursement of overpaid fees, to the appellant in appeal proceedings.
