routine
The judge-rapporteur of the Düsseldorf Local Division granted the defendants' second confidentiality application, filed with their Rejoinder, which the claimant did not oppose in substance. Information on internal availability of data on the attacked embodiment, customer migration times and the economic significance of a business line was classified confidential, and claimant-side access was limited to its representatives and three named in-house IP counsel. On the claimant's request the order clarifies that this access restriction covers only information newly introduced with the Rejoinder: information already disclosed under the earlier order of 15 July 2026, which set no restriction on the circle of persons, cannot be retroactively placed under such a restriction absent reasons, and none were put forward. Leave to appeal was not granted because the order is in line with Court of Appeal case law.
