routine
The judge-rapporteur of the Court of Appeal held that a first-instance confidentiality order under R. 262A RoP that restricts access to specific persons continues to apply in the appeal proceedings unless the order states otherwise, and that the same holds for an appealed order that was upheld, following Curio Bioscience v 10x Genomics. Qualcomm had marked parts of its statements of response and cross-appeals as confidential, assumed the first-instance orders continued to apply, and requested a new R. 262A order in the alternative. Because the first-instance orders extended to different groups of persons for different information, the judge-rapporteur did not issue a new order but required Qualcomm to clarify whether all persons admitted at first instance may see the new filings or, if not, which information should go to whom under which first-instance order.
