routine
The judge-rapporteur of the Mannheim Local Division, after consulting the presiding judge and the technically qualified judge, issued an order preparing the oral hearing in a SEP dispute and closing the interim procedure without an interim conference. The order communicated the panel's preliminary view that the patent is likely valid and infringed, to encourage settlement of a multi-jurisdictional dispute, and set out preliminary remarks on claim construction, novelty and inventive step. It indicated that inventive-step combinations raised for the first time in the reply to the defence to the counterclaim may be an amendment of the case under R. 263 RoP, that a request for accounts is to be read as an information request under Art. 67 and 68(3) UPCA with R. 191 RoP, and that the counterclaim's territorial scope is presumed to match the infringement action. It flagged for the hearing whether the defendants' continued foreign litigation is consistent with conduct as a willing licensee, and provisionally raised the value in dispute to EUR 8 million for each action. All views are expressly preliminary.
