v.
Element Biosciences et al. - UPC-CFI-0001920/2025
routine
Following an interim conference under R. 105.5 RoP, the Lisbon LD judge-rapporteur fixed the agreed values in dispute at EUR 8 million for the infringement action and EUR 12 million for the counterclaim for revocation, giving a combined EUR 20 million for the cost-ceiling scale and a ceiling of EUR 1.2 million. The conference narrowed the dispute to two contested claim features and seven validity attacks, and the judge-rapporteur held that 23 auxiliary requests were not an unreasonable number given that they combine three added features alone or together, while leaving to the panel whether a refined added-matter attack in the Reply was new and late. The claimant was ordered to clarify within two weeks how its direct and indirect infringement allegations differ, since the same acts appeared to be pleaded for both. The order also sets the oral-hearing agenda, presentation and attendance arrangements, and records that the panel will open the hearing with an outline of the relevant issues.
