After the second part of a split interim conference (the first part having dealt with the FRAND defence), the Munich LD judge-rapporteur fixed, by agreement, the value of each of the two infringement actions at EUR 1 million and of each counterclaim for revocation at EUR 1.5 million, applying the Administrative Committee Guidelines' 150% figure, which gives a ceiling for recoverable costs of EUR 400,000 per case. The judge-rapporteur shared a preliminary view that one of the two patents raises fewer validity issues and invited the parties to consider concentrating on it and withdrawing the other case, asked the defendants to consider making the counterclaims conditional on a finding of infringement, and asked the parties for their position on cost allocation if infringement is found only for routers. Objections to the defendants' late filings, including a new clarity attack on an auxiliary request, were left open for the panel, with a deadline for the defendants to respond. The order sets the hearing agenda, technical issues first and FRAND and remedies on a second day.
