Ein Antrag auf Zulassung der Berufung gemäß R. 157 VerfO i.V. mit R. 221 VerfO ist unzulässig, soweit er sich gegen die Ablehnung eines Antrags auf Wiedereinsetzung in den vorigen Stand richtet. Gemäß R. 320.7 VerfO ist gegen eine Anordnung, mit der ein Antrag auf Wiedereinsetzung in den vorigen Stand abgelehnt wird, oder eine Anordnung, mit der einem Antrag auf Wiedereinsetzung in den vorigen Stand stattgegeben wird, eine Berufung nicht statthaft. Daraus folgt, dass auch ein entsprechender Antrag auf Zulassung der Berufung gemäß R. 157 i.V. mit R. 221 VerfO unzulässig ist.

The Court of Appeal's standing judge dismissed an application under R. 157 and R. 221 RoP for leave to appeal against a Local Division order that had rejected two late applications for a cost decision and refused re-establishment of rights. Because R. 320.7 RoP excludes any appeal from an order granting or rejecting re-establishment of rights, an application for leave to appeal is inadmissible in so far as it targets that refusal. As to the refusal of a retroactive extension, the Court confirmed its case law that R. 9.3(a) RoP does not allow extension of the one-month period of R. 151 RoP and that re-establishment under R. 320 RoP takes precedence, so no ground for leave existed. No costs other than the court fee are awarded in proceedings on cost decisions, including where an application for leave to appeal is inadmissible.
