In rehearing proceedings brought by Fujifilm against the Court of Appeal's decision of 2 June 2026, the judge-rapporteur granted the respondents' request under R. 9.3(a) RoP to extend by one week the time period for their written comments on the application for rehearing. The Court weighs all circumstances, in particular the consequences of the extension for the efficient and fair conduct of the proceedings and the other party's rights of defence. The extension was short, the applicant had agreed to it in documented correspondence, and the respondents' representatives had been preparing for a hearing between the same parties before the Düsseldorf Regional Court that was postponed only the day before the application.
