The judge-rapporteur of the Court of Appeal granted the appellant's application under R. 9 and R. 371.4 RoP for reimbursement of overpaid court fees in an appeal against an order dismissing an application for provisional measures. The appellant had paid the value-based fee on the value of the first-instance proceedings (EUR 7,500,000), but the Court of Appeal's final order set the value of the appeal at 50% of that amount (EUR 3,750,000) because one of the two patents was not the subject of the appeal. The Court held that R. 371.4 RoP, under which the Court reimburses overpaid fees where the value is lower than the party's own assessment, applies equally to an appellant in appeal proceedings. Recalculating the value-based fee under the Table of Court Fees, the Court ordered reimbursement of the difference of EUR 37,900.
