Panel 1a of the Court of Appeal rejected the appellants' application under R. 295(m), R. 118.2(b) and R. 242.2(a) RoP to stay an appeal against an infringement decision and the dismissal of their counterclaim for revocation, pending a revocation action that a third party had brought against the same patent before the Paris Central Division after the appeal was lodged. Applying the CoA standard that a stay requires special circumstances justifying the resulting delay, the Court held that a third party's separate revocation action is no such circumstance where the appeal itself covers the counterclaim for revocation, because the Court of Appeal reviews validity itself within the scope of the appeal. A stay also cannot be used to obtain the benefit of attacks that R. 222.2 RoP no longer admits in the appeal. Finally, the revocation action was at the start of its written procedure while the appeal was at an advanced written stage, so a stay would cause a long delay.
