The Munich Local Division permitted the withdrawal of an infringement action and of the counterclaim for revocation under R. 265.1 RoP, both parties having consented to each other's withdrawal, and declared the proceedings closed. The cost decision under R. 265.2(c) RoP followed the parties' agreement that each bears its own costs. The Division set the value of the infringement action at EUR 2 million and that of the counterclaim for revocation at EUR 3 million, applying a '50% plus-rule' for the counterclaim, for an overall value of EUR 5 million.
