This order accompanies the Düsseldorf Local Division's decision of the same day and gives effect to the confidentiality half of the information and accounting order. The information the defendants must provide under sections III.2 and III.3 of that decision is classified as confidential. Access is restricted to the claimant's outside counsel and to two representatives of the claimant named to the defendants in advance. The information may be used only for the purpose set out in the main decision and may not be disclosed beyond it, unless the receiving party learned of it outside these proceedings on a non-confidential basis. A culpable breach may draw a penalty payment, the amount being fixed by the Court on the circumstances of each violation. The grounds are those of the main decision, which explains why R. 262A RoP applies at least mutatis mutandis to information ordered to be disclosed.
