When determining whether a product claim has been directly infringed, the decisive factor is whether the challenged embodiment is objectively capable of fulfilling the features of the patent claim, given its nature and suitability for use.

notable
The Düsseldorf Local Division found direct literal infringement of a product claim to a rotary osteotome and dismissed the revocation counterclaim in full. Its headnote states the test for direct infringement of a product claim: what matters is whether the challenged embodiment is objectively capable, by its nature and its suitability for use, of fulfilling the features of the claim. The defendants' argument that their burs are only ever rotated in the direction in which the alleged cutting faces trail therefore failed, since nothing prevented rotation in the other direction and their own brochure warned that reverse rotation produces high cutting performance. On the pleading standard, the Court held that once the claimant has substantiated infringement with a detailed party expert report, a broad denial does not put the allegation in issue; the defendants had to answer with comparable detail, if necessary with an expert report of their own. Standing was established under Art. 47(2) UPCA through a chain of exclusive licence and sublicence, whose validity despite identical signatories on both sides was governed by Michigan law and unrebutted. On validity, prior art recommending a rake angle of about 0° was held to point away from making that angle negative, so the person skilled in the art would not, rather than merely could not, arrive at the claim.

Nichtigkeitsgründe

Art. 138 EPC
5 Gründe
Novelty
Art. 54 EPC · Art. 138(1)(a) EPC
Patent survived (this ground)
“The novelty attack failed. Passages of one document may be combined only where a clear and unambiguous teaching suggests the combination, and the figures relied on are ordinary schematic drawings from which no concrete angles or ratios can be derived as a novelty-destroying disclosure [147], [177].”
Inventive Step
Art. 56 EPC · Art. 138(1)(a) EPC
Patent survived (this ground)
“The obviousness attack failed. D1 and D3 describe a rake angle of about 0° as advantageous for the cutting face, their remarks on negative angles concerning rotation in the opposite direction, so nothing would have prompted the skilled person to make that angle negative over the whole flute without hindsight; the later-filed D8 and D9 did not answer the 'would' rather than 'could' question either [190]-[195].”
Added Matter
Art. 123(2) EPC · Art. 138(1)(c) EPC
Patent survived (this ground)
“The Art. 123(2) EPC attack failed. The 'heel-side angle' of feature 3.2.3.1 and the 'negative rake angle' of feature 4.2 are the same angle defined by the densifying face, named differently according to the direction of rotation considered, so a positive heel-side angle in the application is a negative rake angle [126]-[128]. Extension over the entire length of both faces was also sufficiently disclosed [131]-[134].”
Insufficiency of Disclosure
Art. 83 EPC · Art. 138(1)(b) EPC
Patent survived (this ground)
“The Art. 138(1)(b) EPC attack failed. The defendants argued that the disclosure does not show how a negative rake angle on the densifying face removes material, but material removal is no condition of working the invention: feature 4.2 merely applies the specification's definition of rake angle to the densifying face [140]-[143].”
Priority
Art. 87 EPC · derivative
Not decided
“The Court expressly left the validity of the priority claim open as not decisive: D1 to D5 are prior art whether or not priority is valid, and D7, which would only be prior art if it failed, goes no further than D1 to D5 and was not relied on for obviousness [196]-[198].”
