routine
The Paris Central Division allowed the withdrawal of a revocation action under R. 265.1 RoP, no decision having been given and the patentee having consented, and declared the case closed. The contested point was the rate of court-fee reimbursement: the action had been filed on 1 October 2025, before the amended fee regime took effect, but the application to withdraw and to be reimbursed was filed on 8 July 2026, after it. The Court held that the version of R. 370.9(b) RoP applicable to reimbursement is determined by the date on which the application for withdrawal and reimbursement is filed, not by the date of the underlying action, and declined the claimant's argument that the Administrative Committee's transitional wording covers only fee-triggering actions and applications. It followed a consistent line of four Court of Appeal decisions on that transitional question and saw no reason to depart from it. The pre-2026 rate of 60% was therefore unavailable and the auxiliary request succeeded at 50%; no decision on recoverable party costs was made because neither party sought one.
