routine
The judge-rapporteur of the Hague Local Division decided a contested confidentiality-club application in an infringement action, permitting counsel to give named persons access to third-party licence materials under the confidentiality regime the parties had agreed in parallel national proceedings, conditional on no licensee having successfully intervened under point 12 of the earlier Final Order. He refused to widen the club from five to seven natural persons: the applicant had not substantiated why the addition was necessary, nor why the Court should diverge from a regime deliberately aligned with the parallel proceedings, and the departure of employees who previously held access did not alter that while current employees retained it. He also declined, at this stage, to impose the five-year bar on participating in or advising upon licence negotiations that the opposing party sought, because the request was unclear as to which persons it targeted and because the parties should first state whether the mirrored national regime contains such a bar. Two working days were set for that clarification and a further two working days for the response.
