The Düsseldorf Local Division refused an attorneys'-eyes-only regime and left the confidentiality club already established in the proceedings unchanged, holding that the minimum access guarantee of R. 262A.6 RoP can be waived only by the party whose own access it protects. A waiver a party gave when it applied for protection of its own information does not bind it when the opponent later seeks a restriction directed against it. US export-control restrictions do not displace the guarantee: the party introducing information into the proceedings bears sole responsibility for satisfying itself that it may lawfully do so, and the Court does not examine foreign export law in infringement proceedings. Where a confidentiality club already exists, the applicant must demonstrate specifically why that club cannot protect the further information; a competitive relationship between the parties never suffices on its own. The Court refused a five-year bar on the club members' technical work as a disproportionate interference with their right to practise their profession, but gave the defendants a deadline within which they may withdraw the submission, in which case it is deemed not submitted and is disregarded.
