v.
Pfizer et al. - UPC_CFI_621/2025
routine
In the parallel GSK proceedings against Pfizer and BioNTech, The Hague Local Division disposed of the counterclaim for revocation of EP 4 066 856 under R. 360 RoP once the EPO Technical Board of Appeal had confirmed that patent's revocation: the action became devoid of purpose, the file was closed, and GSK as the unsuccessful party was ordered to bear the defendants' reasonable and proportionate legal costs, the amount left to separate proceedings or agreement. The revocation has only partial consequences for the infringement action, which also rests on the divisional EP 4 226 941. The defendants' application to stay the proceedings under R. 9 and R. 295 RoP until final EPO decisions was neither granted nor refused: the Court held that the likelihood of the divisional's claims being held invalid is a relevant consideration that can only be assessed once the Board's written grounds on the parent are available, expected by 19 October 2026. The oral hearing of 30 September 2026 was cancelled for rescheduling and two rounds of written submissions ordered, confined to the impact of the EPO decisions on EP 4 226 941.
