The Milan Local Division, sitting as a panel under R. 333 RoP, dismissed the claimant's application to review a case-management order that had fixed a notional common starting date for the statement-of-defence period of two co-defendants. One defendant had been served and its three-month period under R. 23 RoP was about to expire; service on the second, a Hong Kong company, was still running through the Hague Convention channels with no certain information on completion. The panel held that the order was a balanced compromise rather than an extension: it lengthened the period for the served defendant by about 50 days and shortened the period for the unserved one by about the same, measured against the date its own period would have expired. It held that the result stands independently of whether the defendants' refusal to authorise their representatives to accept service was tactical, because the Court has no power to require or compel a representative to accept service, R. 271.1(c) RoP making electronic service on a representative conditional on that representative's own notification of acceptance.
