The Düsseldorf Local Division granted a member of the public partial access to the written pleadings and evidence of concluded infringement proceedings under R. 262.1(b) RoP. The judge-rapporteur confirmed the Court of Appeal standard: a reasoned request must name the documents, state the purpose and explain why access is necessary for that purpose, and the applicant's interest is then balanced against the Art. 45 UPCA interests. Because the main proceedings had already been concluded at first instance, the general public interest in access sufficed and no specific interest in the subject matter had to be shown; the patentee's objection based on parallel proceedings failed because those proceedings had themselves been concluded at first instance. Out-of-court FRAND licensing correspondence was classified as confidential under R. 262.2 RoP and excluded, personal data must be redacted, and the applicant was put under a penalty-backed confidentiality undertaking. The Court also held that court orders are published ex lege under R. 262.1(a) RoP and are therefore not a permissible object of a R. 262.1(b) RoP request.
