The Lisbon Local Division allowed Shenzhen Transsion to withdraw its infringement action (EP 4 123 910) against four Ericsson entities under R. 265.1 RoP, the withdrawal having been filed before the Statement of Defence and the defendants having concurred after being heard. As the parties agreed each would bear its own costs, the Court so ordered. It granted the requested 50% reimbursement of the fixed and value-based court fees under R. 370.9(b) RoP — available where an action is withdrawn before the closure of the written procedure — finding the reimbursement appropriate under R. 370.11 RoP given the early stage of the proceedings. It also ordered the release of the EUR 100,000 security for costs (posted under the order of 26 May 2026) under R. 352.2 RoP, since holding the security was unnecessary once the action was withdrawn and the proceedings closed. The value in dispute was set at EUR 1,500,000.
