v.
Henkel France et al. - UPC_CFI_583/2025
routine
In a combined infringement action and revocation counterclaim over EP 1 725 627 (cold-seal cohesive coatings for flexible packaging), the Paris LD judge-rapporteur issued an interim-conference order under R. 105.5 RoP fixing the case for its 3 July 2026 oral hearing. The order records the agreed main legal issues (claim construction of the disputed features, validity attacks on added matter, insufficiency, novelty over D1 and prior use, and inventive step, plus jurisdiction over the Spanish/UK national parts and time-limitation), notes Bostik's partial withdrawal of the infringement claim as to two of the four accused products, and sets the case value at EUR 6 million (recoverable-cost ceiling EUR 600,000). Substantively, the JR defined the skilled person — an engineer in chemistry with physical-chemistry education and cold-seal-adhesive/flexible-packaging experience, not confined to the narrow field of the invention — and dismissed both parties' cross-applications to exclude late-filed arguments and exhibits, holding that the front-loaded system does not prevent a party from responding to, and further clarifying, arguments already raised, and that exhibits responding to the opponent's case (which could not have been anticipated at the pleading stage) are admissible.
