notable
The Court of Appeal partially set aside a Copenhagen Local Division order requiring a patent-infringement defendant to produce technical documentation under Art. 59 UPCA and R. 190 RoP. The CoA restated the four cumulative constraints on evidence production — specific and substantiated allegations (no fishing expeditions), strict necessity/relevance, proportionality (least-burdensome means and justified burden), and a fair balance of competing rights including confidentiality — and held the impugned order exceeded those limits by extending to furnaces at other sites and to an open-ended 'other materials' category. It confirmed, however, that structural/construction documentation may be evidentially relevant to disputed process parameters even without directly measuring them, that the Art. 59(1) self-incrimination bar excludes only compelled self-accusatory material (not any adverse pre-existing document), that the measure was not a fishing expedition or premature accounting disclosure, and that granting confidential-information access to opposing counsel is compatible with R. 262A RoP. The order was replaced by a narrower measure confined to Oberpullendorf-site drawings and relevant O&M manuals.
