Motorola et al. - UPC_CFI_798/2025
notable
The LD Munich (Judge-rapporteur Voß) granted a Rule 262A RoP application by the Defendants to classify FRAND-related material in their FRAND/Enforcement Rejoinder and a document-production request as Confidential and Highly Confidential under Art. 58 UPCA, excluding it from public access. The Claimant did not contest confidentiality, so the protective grounds outweighed its access interest under R. 262A.5 RoP. The contested point was the size of the access circle for the Highly Confidential licence-agreement and FRAND-royalty material: the Claimant sought access for its external economic expert (Ankura) and his entire team, while the Defendants agreed only to the expert plus two team members. Applying the established UPC access-circle test (CoA Daedalus v. Xiaomi), the court held that an external expert's team access must be limited, named in advance and identifiable — never 'unlimited' or 'indeterminable' — and capped access at the expert plus two team members, releasable only after they are named and a further order issues.
