Pfizer et al. - UPC_CFI_620/2025
notable
Following an online interim conference, the judge-rapporteur of the Hague LD issued a R. 105.5 RoP order setting out the case-management decisions taken to focus the GSK v Pfizer/BioNTech infringement action (and the conditional revocation counterclaims) for a one-day oral hearing on 1 September 2026. The Court set the case values, directed the defendants to select at most five 'most promising' validity attacks and GSK to file 5-10 auxiliary requests mapped to those attacks, and largely excluded late-filed prior art and exhibits under the front-loading principle. It dismissed GSK's R. 176 application for a general right of expert cross-examination, holding that no such general right exists under the UPC rules and that experts may be questioned by the Court only on specific disputed facts (R. 112.2(b)), with the R. 181.2 duties of impartiality and independence applying to party experts even absent an official summons. It also dismissed PBNT's R. 9/262.1 application for access to the pleadings and evidence in the parallel case 616 (Moderna), concerned with the same patent, to protect the integrity of the front-loaded proceedings and for lack of any specific interest.
