Judge-rapporteur Böttcher (LD Mannheim) permitted the withdrawal of an application by the law firm Bardehle Pagenberg, acting for a third-party licensee of Ericsson, for access under R. 262.1(b) RoP to the written pleadings and evidence in the Ericsson v Verifone/Adyen infringement proceedings (UPC_CFI_661/2026). The applicant's client, a party to a global licence agreement (GLPA) with Ericsson, sought to verify whether the confidentiality of the GLPA — portions of which Ericsson had included in redacted form in its complaint — would be adequately protected. The judge-rapporteur had signalled that Ericsson could not expect a production order for the third-party licence agreement if it failed to inform the affected licensee of the intended disclosure and the confidentiality regime sought; Ericsson then updated its licensees, prompting the applicant to withdraw. Applying R. 265 RoP by analogy and finding no precluding interests, the order permitted the withdrawal, closed the proceedings, and awarded no costs, access applications under R. 262.1(b) not carrying a costs entitlement absent an exceptional case under Art. 69.3 UPCA.
