⚖️Revocation Action

GERMAN: - 1.

notable
The Paris Central Division revoked EP 1 516 720 as granted for lack of inventive step over prior art WO 98/01279 (D19), but maintained the patent in the amended form of Auxiliary Request 1. The Division confirmed ex officio that a revocation action is admissible even where the patent has expired by lapse of time, provided the patentee may still assert infringement damages for the period of in-force protection — a point the Division addressed sua sponte even though defendant did not challenge standing. On substantive patent law, the Division applied the Court of Appeal's Meril v Edwards / Nanostring v 10x inventive-step framework and held that the court is not bound by the problem stated in the patent but may derive the objective technical problem independently from description and drawings. In examining auxiliary requests, the Division held it is bound to the patentability grounds raised by the claimant specifically against the auxiliary request — objections raised only against the granted version do not automatically carry over.
