ENGLISH: As a rule, the Statement of claim should contain the facts and legal arguments necessary to justify the jurisdiction of the Court. Where the UPC has jurisdiction on the basis of Article 7(2) of Regulation 1215/2012 as the court of the place where the damages occurred or threaten to occur, said article does not provide jurisdiction for infringement in non-member states of the UPCA.

notable
CoA (led by President Grabinski) sets aside Paris LD's jurisdiction over non-CMS national parts of EP 2 949 070 in a case involving Adobe, OpenAI, Truepic, and the C2PA coalition against KeeEx. Art. 7(2) Brussels Ia (court of the place where damage occurred) gives jurisdiction only for damage in the court's own territory — it cannot extend to non-CMS countries. The CJEU BSH judgment on Art. 4(1)/24(4) does not apply to Art. 7(2)-based jurisdiction. Art. 71b(3) (extra-territorial jurisdiction over non-EU defendants) was not adequately pleaded — KeeEx's bare assertion that 'damage is global' was insufficient. The Statement of claim must contain the facts and legal arguments justifying jurisdiction. Art. 14 of the French Civil Code is not applicable before the UPC.
