The CoA rejected Hurom's R.36 request for further written pleadings. NUC's arguments on inadmissibility of new auxiliary requests and new inventive step arguments were raised in response to Hurom's Grounds of Appeal and could not have been submitted earlier. However, the oral hearing provides sufficient opportunity for Hurom to comment. The principle of fair and efficient conduct (Art. 42(2) UPCA, Art. 41(3) UPCA) required rejection, particularly since Hurom waited two months after filing of the Statement of Response before lodging the R.36 application.
