ENGLISH: The one-year time period set out in Rule 12.1 of the EPLC Rules is not discriminatory.

The President of the CoA rejected a petition for review of the Registrar's refusal to enter a European Patent Attorney on the UPC representative list under R. 12.1 EPLC Rules. The applicant relied on a predecessor qualification (Kandidatenkurs Fischbachau) but filed after the one-year transitional grace period expired on 3 June 2024. The President held that R. 12.1 imposes a substantive time limit (not merely a procedural deadline) and that the one-year grace period is not discriminatory.
