During the inspection of Palo Alto’s Munich sales office, no Next Generation Firewall hardware was found and the single sales person present had no access to the technical systems Centripetal wanted to monitor. The court held that a saisie order is limited to inspecting what is found at the premises — the defendant has only a passive obligation to tolerate the inspection, not an active obligation to set up systems, increase access rights, or bring hardware from other locations. Digital inspection is limited to what is accessible in ordinary business at the premises. The defendant’s refusal to arrange remote access from US headquarters did not constitute non-compliance.
