In cases where the parties reach a settlement out of court, a thorough examination of each and every aspect that could affect the value of the action is not necessary. An estimated assessment based on the known circumstances is sufficient.
The Düsseldorf Local Division allowed the withdrawal of the infringement action as well as the counterclaim for revocation. Since the parties could not agree on the value in dispute, the Court clarified that it did not have to examine every aspect affecting the value in dispute and an estimated assessment would be sufficient.
