v.
NUC Electronics - UPC_CFI_162/2024
landmark
The Mannheim LD delivered a landmark infringement decision establishing a comprehensive framework for the intertemporal applicability of UPCA substantive law to traditional European bundle patents. The court held: (1) UPCA substantive law applies to acts committed after 1 June 2023; (2) national law applies to pre-UPCA acts due to the prohibition of retroactivity under the VCLT and EU law; (3) for ongoing acts crossing 1 June 2023, UPCA applies from a normative (not formalistic) perspective, with a reservation allowing parties to invoke favorable national law for pre-UPCA acts. The court also held that Art. 26 Brussels Ia Reg. prevails over R. 19.7 RoP for jurisdictional objection timing, that Art. 34 UPCA is procedural (scope of decisions) not substantive, and that acts outside UPC territory (here: Korea) constituting support of infringement with control over distribution amount to perpetration under Art. 25 UPCA. Infringement of claim 1 was found; comprehensive remedies were granted across five UPCA states.
