v.
Samsung et al. - UPC-CFI-0001214/2026
notable
The Mannheim Local Division granted a third party access under Rule 262.1(b) RoP to the written pleadings and evidence in a closed infringement action and its revocation counterclaim. Balancing the interests, the judge-rapporteur held that once the proceedings are closed the protection of their integrity no longer carries decisive weight, so the general principle that the register and the proceedings are open to the public prevails, subject to personal data and confidential information. Additional weight came from the applicant being sued by the same claimant on the same patent, from the request being limited to non-confidential and redacted material, and from the absence of any objection by the parties. The request was nonetheless refused in part: wording covering 'the briefs and evidence submitted by the parties' generally, and 'potential further pleadings' selected by a relevance criterion of the applicant's own, lacks the specificity a request must have, following the Court of Appeal in Gowling WLG v Sumi Agro.
